America has problems, but America is NOT THE PROBLEM!~
OK NOW WHAT?
Published on June 14, 2005 By Moderateman In Politics
I have been sidelined with the flu and since I have no immune system, anything I catch lays me low.

The question I want to ask is.

OK we close gitmo, now what?

Lets try to keep politics out of this and discuss what do we do with these killers and terrorist, where do they go, home? American prisons? where, at whos expense? who is in charge of them, how do we treat them?

Just what crime would you charge them with? Found guilty? Of what?

I'm sure there are international laws, therefore international crimes they could be charged with. But locking people up without charge or trial is not the way to go, IMO.

Nope! Can you name one? Betcha can't!

But I will always jump on arrogance when I see it and would expect the same treatment should I be so arrogant myself

Lucas,

Arrogance is one of the major qualities that helped most nations in the world survive

To a degree, I understand what you are saying, but I don't support this view. Overt arrogance is just an invitation for someone else to shoot you down (I mean this in a purely rhetorical sense, of course).

Pardon my ignorance, but who is Justin Gentry?

Drmiler,

Can you name one? Betcha can't!

Yeah, okay, I didn't say I KNEW there were any applicable charges, but surely, after the years pursing war criminals of all sorts, there would have to be some charge that would fit the bill. I would be very surprised if there isn't, to be quite honest.

--Thinking about it, i don't think arrogance is the right word..oh and Justin Gentry was a close friend of mine who died Sunday of Diabetes...it was quite a shock... (here is the link to a thread i posted about him : http://lucasbailey.joeuser.com/index.asp?aid=78515 )

"I" can't find any. See terrorism is a relatively new term. Think about this for a moment. When were the last "war crime tribunals"? WW2? They had no definition back then. Hell the Geneva accords haven't even caught up to terrorist acts yet.

I could respond to a lot of points that were raised in this discussion, but I will respect the original post and not get political (as I'm sure it would, as any questioning of America/Bush is immediately jumped on and it soon resorts to attacks, rather than discussion)

Some Americans really do scare me from reading around the Joe User sites for the last couple of months!

Arrogance and doing whatever you want to do is not admirable in either a person or a nation but frequently the said person or nation are the ones who find this the hardest to see

Correct me if I'm wrong (and I'm sure you will) but was Milosevic not tried for war crimes recently, due to the conflict in the former Yugoslavia?

I went and looked and your correct. But I was unable to find any convictions on him after 30 min of googling. Also what he was being tried for could not be considered "terrorist" acts. So be that as it may, they still haven't come up to speed on terrorism as a war crime.

I think this is where the problem may come from, that this sort of global terrorism, that is being blurred with war, seems a new situation for which the international community is not legally prepared. Therefore the grey areas allow for the justification of things such as Gitmo, when there is a lack of a better alternative, even when it appears to be wrong.

These guys can't be in some "legal limbo" they have to belong somewhere to be tried/convicted etc. (whatever you want to call it)

And I agree 100%! However, until someone changes the rules or writes new definitions for war crimes so that we can try them....they need to stay right where they're at.
